Kalimanshi, others assault trial fail to commence
Trial in a case in which PF cadre Innocent Kalimanshi and two others are charged with assaulting three people has failed to commence because one of the accused persons is unwell.
Kalimanshi, 34, and Capson Mwanza, 46, appeared before magistrate Nthandose Chabala but their co-accused Nathan Phiri, 43, was not before court.
The trio are charged with three counts of assault occasioning actual bodily harm.
It is alleged in count one that on October 26 this year, the three assaulted Isaac Banda and occasioned him actual bodily harm.
In count two, Kalimanshi, Phiri and Mwanza are alleged to have on the same date assaulted Muhammed Mutale and occasioned him actual bodily harm.
The accused in the third count are alleged to have also assaulted Kingsley Nyondo on the same day.
Kalimanshi and his co-accused pleaded not guilty.
When the case was called for commencement of trial, only Kalimanshi and Mwanza were before court.
Phiri's surety Nicholas Chandwe, a driver of Matero, explained that the accused was not before court because he is unwell and produced his sick note.
The State indicated that they had four witnesses lined up.
However, magistrate Chabala adjourned the matter to December 28, this year for trial and warned witnesses to attend the court session.
